Effective Date: July 04, 2026
Thank you for visiting the website of The Law Offices of Jerry Nicholson, APC (“we” or “us”). These Terms of Use (“Terms”) are the legally binding terms that govern your use of our website at https://jnlawoffices.com (the “Site”). Please read these Terms carefully before using the Site, because they affect your legal rights and obligations (including requiring arbitration, prohibiting class relief, and limiting our liability).
1. Acceptance of Terms
If you do not agree with these Terms, including the Privacy Policy incorporated by reference, please do not use this Site. By using the Site you agree to these Terms. Some areas of the Site may be subject to additional terms, which are supplemental to these Terms.
2. No Legal Advice; No Attorney-Client Relationship
The content on this Site is provided for general informational purposes only and does not constitute legal advice. Reading this Site, contacting us through it, or submitting information through a form or email does not create an attorney-client relationship. An attorney-client relationship is formed only through a signed written engagement agreement. Do not send confidential or time-sensitive information through the Site; information submitted before an engagement may not be treated as privileged. Prior results do not guarantee a similar outcome.
3. Updates to Terms
These Terms may be revised by posting updated terms on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
4. Legal Capacity
This is a general-audience Site for adults. By using the Site, you represent that you have the legal capacity to enter into these Terms.
5. Accuracy of Information
If you provide details through the Site, you agree that they will be correct, current, and complete. We may refuse or terminate access if we believe the details are inaccurate.
6. Disclaimer of Warranties
Your use of the Site is at your own risk. The Site and all content are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the fullest extent permitted by law, The Law Offices of Jerry Nicholson, APC will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of, or inability to use, the Site. If you are dissatisfied with the Site, your sole and exclusive remedy is to discontinue use. Nothing in these Terms limits liability that cannot be limited under applicable law.
8. Indemnification
You agree to indemnify and hold harmless the firm and its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or your violation of these Terms or the rights of any third party.
9. Dispute Resolution; Binding Arbitration; No Class Relief
Please review this provision carefully. To the extent permitted by law, you and the firm agree that disputes relating to the Site will be resolved individually through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (as supplemented by the Supplementary Procedures for Consumer-Related Disputes), rather than in court, except for matters that qualify for small claims court. You agree that any claim must be brought in your individual capacity and not as part of any class or representative proceeding, and you waive any right to a jury trial. Any claim must be commenced within one (1) year after it arose. This provision survives termination of these Terms. (This provision governs website disputes and does not alter any separate engagement agreement between you and the firm.)
10. Intellectual Property
The Site and its materials are protected by copyright, trademark, and other proprietary rights owned by the firm or others. You may access and display the materials for non-commercial, personal use only. The materials may not otherwise be copied, reproduced, republished, distributed, or used without our authorization.
11. Your Use of the Site
You agree to use the Site only for lawful purposes. You may not misuse the Site, attempt unauthorized access, introduce malware, engage in spamming or system abuse, or interfere with the operation or enjoyment of the Site by others.
12. Third-Party Sites
The Site may link to other websites. We are not responsible for the accuracy, legality, privacy practices, or content of third-party sites, and inclusion of a link does not imply endorsement.
13. Governing Law
Except for the arbitration provision (which is governed by the Federal Arbitration Act), these Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.
14. Notice for California Users
Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (800) 952-5210.
